U.S. Judge William Shubb of Bakersfield, CA; dimwitted boob

The state of California provided William B. Shubb after he graduated from the University of California Berkeley in 1993.

Former President George H.W. Bush was duped into appointing Billy as a U.S. District Court judge for the Eastern District of California in 1990. Billy didn’t receive the appointment because he was the most qualified attorney in the greater Bakersfield area. He received it because he had proven to be a reliable lackey for the local political hacks.

In one matter, Judge Shubb was assigned to preside over a case involving a woman who filed a lawsuit against Vacaville Police Officer Stuart K. Tan for applying such force in arresting her for trespassing as to break her arm.

During the pendency of the case, Billy the Buffoon granted summary judgment as to liability to Officer Tan by claiming he was entitled to qualified immunity as to the false arrest claim because it is reasonably arguable that he had probable cause to arrest Ms. Close based on reports that she refused to leave an examination room.

• “Clearly established law prior to Close’s 2016 arrest held that non-trivial force was unconstitutionally excessive when used against an individual who was passively resisting arrest.”
• “Thus, there are genuine issues of material fact sufficient to survive summary judgment, regardless of whether Close was passively resisting or minimally resisting.”
• “A reasonable jury could find that exerting enough force on Close’s arm to fracture it, partially dislocate her elbow, and tear the soft tissue, rose to the level of non-trivial force.”

Of course, Billy does not much give a damn how many times he is overruled by an Appellate Court since he is well aware that no judge in the Federal Judicial System has ever been tossed off the bench for being an incompetent boob.

As we speak (ca. May 2021), Billy continues to practice his so-called brand of jurisprudence as a U.S. District Court judge in Bakersfield, California.
