Judge Henry Walsh of Ventura, CA; incompetent boob

The state of California presented Henry J. Walsh with a law license in 1970 after he graduated from Loyola University School of Law.

Former Gov. Pete Wilson was duped into appointing Hank as a Ventura County Superior Court judge in 1998. Hank didn’t receive the appointment because he was the most q        qualified attorney in the greater Ventura County area. He received it because he had proven to be a reliable lackey for the local political hacks.

In one matter, Hank was assigned to preside over a case relating to an arbitration matter involving Modern Mobile Homes (MMH), Inc. and Raymond and Joanna Bilodeau, the purchasers of a $99,415 remodeled used mobile home from Modern.

The note executed by Raymond and Joanna in favor of MMH note provided that any dispute or claim in law or equity arising between them out of this agreement, or any resulting transaction, shall be decided by neutral binding arbitration. The note went on to state: ““If any action is instituted on this Note, I/we promise to pay such sums as the Court may fix as attorney’s fees.”

After paying Modern $45,000 towards the $99,415 purchase price, Raymond and Joanna sued MMH, alleging structural defects and sought rescission of the purchase contract.

The arbitrator determined that Modern could keep the $45,000, declared the note canceled, and returned the home to Modern. After appealing the arbitrator’s decision to Hank, he denied the motion to vacate the award to MMH and went further by ordering Raymond and Joanna to pay MMH $10,000 in attorney fees.

Subsequently, Raymond and Joanna successfully appealed Hank’s asinine award of attorney fees to Division Six of the Court of Appeal, which made the following statements in its reversal of Hank’s award.

• “Here the arbitration agreement does not provide for an award of attorney fees.”
• “In the absence of any agreement providing for an award of attorney fees in an arbitration proceeding, the express terms of section 1284.2 preclude such an award.”
• “A petition to vacate an arbitration award is not an action on a note.”
• “An attorney fee provision applicable to a substantive claim does not extend to a petition to vacate an arbitration award resolving that claim.”

Of course, Hank the Incompetent Boob does not much give a damn how many times his asinine rulings are overturned by the Court of Appeal because he knows that no federal judge has ever been removed from office for being a Moron. Additionally, he has absolutely no concern for how much taxpayer money is wasted as a direct result of his gross incompetence.
