Attorney Michael Portnoy of Perrysburg, OH; cheating loser

 

The state of Ohio presented Michael David Portnoy with a law license in 1988 after he graduated from the University of Toledo School of Law.

 

FYI: The University of Toledo Law School is ranked as the 149th best law school in the country out of 200 ABA(American Bar Association) accredited law schools.

 

It should be noted that Portnoy was associated with attorney Dale R. Crandall who has been disbarred and David R. Phiels, Jr. who had his law license suspended. Despite this association, the Toledo Bar Association recommended Portnoy’s employment to the person he victimized as set forth below.

 

The Toledo Bar Association found Mikey guilty of engaging in the following misconduct.

  • Entered into an agreement to charge or collect an illegal or clearly excessive fee
  • Failed to promptly deliver to his client funds she was entitled to receive
  • TBA referred Kellie Payne to Portnoy re: claim v. Kistler Ford re: purchase of 2013 Ford Explorer XLT and news report re: issues with carbon monoxide exposure which Kellie claimed seemed to her to explain physical complaints she related to the use of the Explorer
  • Advised his client Kellie to draft demand letter to Ford Motor
  • Kellie provided draft of letter to Mikey, who made some changes, added his name as being copied with the letter, and told her the letter would intimidate Ford because he’d “beaten them before”
  • After receipt of the letter, Ford rejected her demand
  • Subsequently, Ford’s outside counsel offered to by back the Explorer, refund the $20,00 in payments and her $8,500 trade allowance
  • Immediately after receiving the settlement offer, Mikey presented Kellie with a second fee agreement which provided that if case settled before trial he receives 33% and 40% if trial commences
  • Mikey then advised Kellie to reject Ford’s settlement off and told her she “could get a lot more money”
  • Within 30 days of the settlement rejection, Mikey filed a class action lawsuit in the Lucas County Court of Common Pleas against for Ford and on behalf of Kellie individually
  • Lucas County judge Jeffrey Helmick ordered the case to be removed to the federal court in Toledo
  • After more than two years later, the federal court granted Ford’s motion to dismiss the seven warrant counts filed by Mikey, leaving only Kellie’s personal-injury claim
  • Knowing he overplayed his hand by filing a sham class action warranty claim against Ford, Mikey demanded that Kellie pay him an addition $1,500 in addition to 33% of any settlement because he claimed he worked really hard on her case and was only receiving a few cents per hour for his time
  • For subsequently offered and Kellie agreed to settle the matter for $14,000
  • Even after Kellie settled with Ford for $14,000, Mikey continued to request additional fees from Kellie
  • Based on the $14,000 settlement, Mikey told Kellie he was entitled to $6,000, which is false because 33% of $14,000 is $4,620

All that remains now is to see what if any punishment is meted out to Mikey by the apologists for Attorney Misfits sitting on the Ohio Supreme Court.

 

As we speak (ca. September 2021), Mikey practices his so-called brand of law with the Law Office of Michael Portnoy at 1070 Commerce Drive in Perrysburg, Ohio.
