Attorney James Levinson of Benson, NC; repeat offender

 

The state of North Carolina presented James R. Levinson with a law license in 1974 after he graduated from the North Carolina State University School of Law.

 

The Grievance Committee of the North Carolina State Bar found Jimmy guilty of engaging in the following misconduct.

 

Jimmy’s 1st bite at the Attorney Misfit Apple Tree

  • Collected nearly $15,000 from a court-appointed, indigent client
  • Did not adequately explain to the client that he could continue as appointed counsel free of charge to the client
  • Failed to promptly notify the court that the client had sufficient funds to pay for private counsel
  • Knowingly disobeyed an obligation under the rules of a tribunal

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Texas Supreme Court punished Jimmy by gifting him with a complimentary reprimand.  

 

Jimmy’s 2nd bite at the Attorney Misfit Apple Tree

 

Jimmy’s misconduct in this matter involved his representation of clients in a bankruptcy case, which is as follows.

  • Failed to maintain the original signed version of all electronically-filed documents
  • Failed to disclose all compensation he received for the bankruptcy case
  • Filed conflicting documentation regarding his compensation
  • Failed
  • Improperly collected additional legal fees from two clients while the bankruptcy case was pending and
  • while the automatic stay was in effect
  • Failed to communicate pertinent information to his clients at the time he collected additional legal fees
  • Made material omissions in documents filed with the Bankruptcy Court on behalf of his clients
  • Failed to promptly inform his client of his receipt of funds for said client
  • Failed to properly handle client funds
  • Neither promptly turning funds over to the bankruptcy trustee nor deposited the funds into a trust account
  • Engaged in a representation involving a concurrent conflict of interest

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Texas Supreme Court punished Jimmy by gifting him with a complimentary reprimand.  

 

And lastly, as one would suspect, Jimmy fails to disclose the misconduct set forth above on his self-serving website at www.levinsonlaw.us. Apparently, he decided to conceal said relevant facts from prospective clients to prevent limiting his future victim pool.

 

As we speak (ca. May 2021), Jimmy practices his brand of law with the Levinson Law Firm at 124 East Main Street in Benson, North Carolina.
