The Appellate Division, First Department Grievance Committee found Dick guilty of engaging in the following misconduct.

Entered into business transaction with a client with differing interests without advising of independent legal counsel

IOLA funds to pay for the loan and using IOLA funds to pay rent and utilities, expenses unrelated to the practice of law

Failed maintain client funds in a special account separate from business or personal accounts

Failed to have a separate account for matters in which he acted as a trustee and in which he acted as an executor

Failed to issue a retainer or written letter of engagement to a client

Failed to maintain required bookkeeping records for his IOLA account
As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the First Department Grievance Committee punished Dick by gifting him with a complimentary censure.
As we speak (ca. May 2021), Dick practices his so-called practice of law with the Law Office of Richard S. Peskin at 2 Arabian Court in East Moriches, New York.
