Former Judge Donald R. Roberts of Malone, NY; bullying misogynist

In 1993 Donald succeeded in duping the voters into electing him as a justice of the Malone Village Court in Franklin County, which is about 25 miles south of the Canadian border.

During his tenure on the bench, Donnie did everything he could to cement his status as a die-in-the-wool misogynist. In a case heard by Donnie, a husband was charged with assault in the 3rd degree for kicking his wife to the floor, kicking her in the stomach and choking her, which required her to be treated for bruises at a hospital. Donnie responded by saying, “Every woman needs a good pounding now and then.”

As to orders of protection for abused women, Donnie told fellow judge, Andrew Simays, “I think these orders of protection are a waste of time.”

When a woman he convicted of dog control violations complained to a court clerk about the amount of the fine, in open court Donnie accused her of unleashing the dog on her ex-husband out of spite and for generating crime by carrying cash receipts from her bar to pay the fine.

A local dentist, Dr. Gallagher sued in Donnie’s court on a collection matter. At a hearing, Donnie belittled the defendant and falsely told him he would have to pay Dr. Gallagher’s lost earnings and travel expenses for attending any court proceedings. Ends up that Donnie was a longtime patient of Dr. Gallagher, a fact he concealed from the defendant.

Another case involved an unemployed mother who Donnie convicted of “Theft of Services” when she didn’t pay $1.50 in cab fare. Donnie imposed a fine of $90, which she asked to make payments of $20 until she paid it off. When she made her first payment she only had $5 and told the clerk she’d pay the other $15 in a week or two. When Donnie found out about the $5 payment he became very angry and did the following:
  1. Issued an arrest warrant for the woman
  2. When she turned herself in, ordered her into chambers and told her he was going to make an example of her in regards to paying fines on time
  3. He then summarily sentenced her to 89 days in jail
  4. In jailing her, he knowingly violated her constitutional due process rights
After ruling that the record provided that Donnie was a biased, mean-spirited and bullying judge, the Commission on Judicial Conduct ordered that he be removed from the bench.

It is rumored that Donnie is now employed as a bouncer at the Diamond Dolls strip club in Plattsburgh, New York which is about 50 miles east of Malone.

Apparently Donnie was relegated to this job after his application as a guard at the Clinton Correction Facility in Dannemora was denied because he was too much of a bully.
