U.S. Judge Miranda Du of Reno, NV; ethical goblin

 

The state of Nevada presented Miranda Mai Du with a law license in 1994 after she graduated from the University of California Berkeley School of Law.

 

FYI: Former President Barack Obama was duped into nominating Miranda Du as a Nevada District Court judge in August 2011. Miranda didn’t receive the nomination because she was the most qualified attorney in the greater Las Vegas area. She received it because she had proven to be a reliable lackey for the local political hacks.

 

It should be noted that this isn't the First article dealing Judge Du's conduct. She was previously a recipient of a Dufus Award. That article can be viewed by visiting the URL at the end of this article. 

 

The following deals with an ethical complaint filed against Judge Du by attorney Michael S. Kasanoff of Red Bank, New Jersey. Mr. Kasanoff’s complaint deals with Judge Du’s conduct as it relates to Amarin Pharma, Inc. v. Hikma Pharmaceuticals, USA, Inc., et. Al. The complaint deal with the subject matter set forth below.

 

After presiding over a bench trial in January 2020 involving Amarin, Judge Du ruled that Amarin patents for Vascepa were invalid on the grounds of obviousness, a ruling that caused Amarin to lose billions in market cap, and causing the stock to lose 70% of its value.

 

In February 2020 (within a month of her verdict), Judge Du made the following statement during an interview with the Nevada Lawyer magazine.

 

“I get tutored on varied technical issues involved in patent cases such as

learning how tasers work or the benefits of fish oil.”

 

It is undisputed that Amarin’s Vascepa is the first and only EPA prescription approved by the FDA to lower remarkably high triglycerides. Moreover, Vascepa has been approved, along with certain medicines (statins) to reduce the risk of heart attack, stroke, and certain types of heart issues requiring hospitalization in adults with heart (cardiovascular) disease, or diabetes and 2 or more risk factors for heart disease.”

 

In contrast to Vascepa, most fish oil is not FDA approved to treat medical conditions, including remarkably high triglycerides.

 

The misconduct alleged by Mr. Kasanoff is as follows.

  • Improperly commented on the merits of matters relating to the Amarin litigation
  • Failed to perform her judicial duties fairly, impartially, and diligently
  • Failed to respect and comply with the law
  • Failed to act in a manner promoting public confidence in the integrity and impartiality of the judiciary

It is abundantly clear that Judge Du engaged in unethical conduct by acting as an advocate for “fish oil” while improperly denigrating Vascepa, an FDA approved drug.

 

Sadly, a successful appeal overturning Judge Du’s highly questionable verdict against Amarin will never begin to ameliorate the billions in losses to the company and its shareholders.

 

It goes without saying that Judge Du doesn’t much give a damn if her absurd ruling is overturned by the 9th Circuit Court of Appeal. She well knows that no federal judge has ever been tossed off the bench for being an ignoramus for engaging in biased conduct.

 

All that remains now is to see what if any punishment is meted out to Judge Du by the Judicial Council of the Ninth Circuit Court of Appeals.

 

And lastly and most unfortunately, Judge Du may well be engaged in dispensing with justice rather than dispensing justice for another 30 or more years since she is only 51 years old as we speak (DOB: 1969).
