Former Judge Richard Greenwood of Twin Falls, ID; incompetent boob

The state of Idaho presented Richard Dale Greenwood with a law license in 1977 after he graduated from the University of North Dakota School of Law.

In one matter, Dick was assigned to preside over a case involving Victoria H. Smith vs. Treasure Valley Seed Company and Smith’s claims for breach of contract regarding the sale of lima beans.

Dick ordered the case to be dismissed due to Victoria’s death despite her son Vernon’s argument that he was a true party in interest because he possessed a Durable and Irrevocable Power of Attorney to act on Victoria’s behalf. In addition, Dick awarded Treasure Valley attorney fees by ruling that the son’s lawsuit was time barred.

Subsequently, Vernon’s attorney filed an appeal to the Fourth Judicial District Court of Appeal, which reversed Dick’s absurd award of attorney fees. In doing so, the Court of Appeal ruled in part as follows.

Even though Vernon was not a true party in interest due to his mother’s death prior to the filing of the lawsuit,

• “We have long defined a party aggrieved as any person injuriously affected by the judgment.”
• “Because the district court assessed attorney fees jointly and severally against Victoria and Vernon,
• Vernon is an aggrieved party entitled to appeal the award of attorney fees.”
• “We conclude there is a real party in interest for this appeal.
• “We hold that the district court committed reversible error by assessing attorney fees jointly and severally against Victoria and Vernon, as counsel.”
• “We vacate the district court’s award of attorney fees to TVSC and remand for further proceedings consistent with this opinion.

It is plainly clear that Dick doesn’t much give a damn how many times his ignorant rulings are overturned by a higher court because he knows for a fact that no judge in Idaho has ever been bounced off the bench for being an ignoramus.
