Attorney Robert Trobich of Charlotte; thief, serial offender

 

The state of North Carolina presented Robert K. Trobich with a law license in 1988 after he graduated from North Carolina Central University of School of Law.

 

FYI: North Carolina Central University School of Law is ranked as the 168th best law school in the country out of 200 ABA (American Bar Association) accredited law schools.

 

The Grievance Committee of the North Carolina State Bar found Bobby guilty of the following misconduct.

 

Bobby’s 1st bite at the Attorney Misfit Apple Tree

  • Billed the state for reimbursement of visits to indigent clients in the Mecklenburg County jail that never happened (thief)
  • Late to respond to grievance investigators (Up yours, said Bobby!)
  • Also failed to respond to a follow up letter requesting additional documentation from ethics investigators (Screw you, said Bobby!)

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentary reprimand.

 

Bobby’s 2nd bite at the Attorney Misfit Apple Tree

  • Failed to timely respond to grievance investigators (Up yours, said Bobby!)

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentary reprimand.

 

Bobby’s 3rd bite at the Attorney Misfit Apple Tree

  • Misconduct involved selfish motive
  • Misconduct involved multiple offenses
  • Submitted false representation to grievance committee (Screw you, said Bobby!)
  • Intended to cause resulting harm or potential harm to client
  • Committed acts where harm or potential harm to client was foreseeable
  • Circumstances reflect Bobby’s lack of honesty
  • Elevated his own interests above that of his client
  • Actions potentially had negative impact on public’s perception of legal profession
  • Engaged in conduct involving fraud, deceit, dishonesty, or misrepresentation
  • Misled [lied] to client about settlement, the source of funds, and the release to conceal his neglect of her case and prevent her from discovering the true status of her civil action
  • Failed to act regarding opposing counsel’s discovery requests and court order compelling a response to said discovery requests

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentarystayed 2-year suspension of his law license.

 

In truth, the comedians sitting on the North Carolina Supreme Court didn’t mete out any meaningful punishment to Bobby.  

 

Bobby’s 4th bite at the Attorney Misfit Apple Tree

  • Failed to appear at bankruptcy hearing on client’s behalf
  • Bankruptcy court entered an order wherein it found that Bobby’s Chapter filing was the result of poor legal advice that Bobby gave to the debtors regarding whether the trustee would have authority to sell the debtors’ real property to satisfy outstanding tax liens
  • Bankruptcy court ordered Bobby to pay $10,000 to the trustee and $8,100 to Charles Green of Prudential Carolinas Realty
  • Bankruptcy court also required his clients to pay $5,336.38 in attorney's fees and held Bobby jointly and severally liable with your former clients for that amount
  • Clients paid the $5,336.38 to the trustee as ordered by the bankruptcy court
  • Bankruptcy court ordered that Bobby reimburse his clients for the $5,336.38 within 30 days, which he failed to do
  • Client’s new attorney filed motion for contempt and sanctions against Bobby for failing to pay his clients the $5,336.38 ordered by the court
  • Despite being noticed for a hearing on the contempt/sanction motion, Bobby failed to appear
  • Based on Bobby’s failure to appear at contempt/sanction hearing, the Bankruptcy court ordered him to pay $1,000 in attorney fees and expenses to his former client’s new attorney and again ordered he pay the $5,33 6.58 and if he didn’t he would be ordered to pay an additional sum of $50 day he failed to pay said amount
  • Bobby failed to pay the $1,000 and $5,336.38 that included a $50 per day penalty thereby causing new counsel to file for additional sanctions to be imposed upon Bobby
  • Subsequently, the Bankruptcy court entered a money judgment against Bobby for $15,456.38
  • The Bankruptcy court scheduled a show cause hearing to determine if Bobby should be held in contempt; however, he failed to appear
  • The Bankruptcy court found Bobby in contempt and barred him from practicing in the court until he purged himself of the contempt and payed all sums due under the judgment previously entered against him
  • Several months later, Bobby’s former clients file yet another motion for additional sanctions due to his failure to pay the court ordered $15,4.38, which led to the court entering a judgment against bobby for $58,m936.38 plus an additional $50 per day for failing to pay said amount
  • Engaged in conduct prejudicial to the administration of justice

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Bobby by gifting him with a complimentary censure.
