Attorney Willie Gilbert II of Wilson, NC; thief, serial offender

The state of North Carolina presented Willie D. Gilbert II with a law license in 1990 after he graduated from Wake Forest University Law School.

The Grievance Committee of the North Carolina State Bar found Willie guilty of the following misconduct.

Willie’s 1^st bite at the Attorney Misfit Apple Tree

• Submitted with the North Carolina Industrial Commission (NCID) proposed order stating he would receive $45,000 of the $60,000 lump sum paid to his client as an attorney fee
• NCID ruled that of the $60,000 lump sum Willie would be limited to $15,000
• Despite the ruling by NCID, when Willie received the $60,000, he retained $45,000 for himself
• Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
• Engaged in criminal conduct adversely reflecting on fitness to practice
• Collected an illegal fee (thief)
• Engaged in conduct prejudicial to the administration of justice
• Misconduct prejudiced his clients
• Wrote checks on insufficient funds account to the EP Mart and his wife (rubber)
• Willie was motivated by a dishonest or selfish motive.
• Engaged in a pattern of misconduct.
• Engaged in multiple violations of the Revised Rules of Professional Conduct

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Willie by gifting him with a complimentary 2-year suspension of his law license.

Willie’s 2^nd bite at the Attorney Misfit Apple Tree

• Commingled client funds with personal funds
• Failed to promptly pay or deliver to a third party as directed by his client funds he held for said purpose
• Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
• Intended to cause the resulting harm or potential harm to his clients
• Elevated his own interest above the interests of his clients
• Engaged in misappropriation [theft] of clients' funds

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Willie by gifting him with a complimentary stayed 5-year suspension of his law license.

In truth, the comedians sitting on the Grievance Committee didn’t mete out any meaningful punishment to Willie.

Willie’s 3^rd bite at the Attorney Misfit Apple Tree

• Knowingly made a false statement of material fact or law to a tribunal
• Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
• Engaged in conduct prejudicial to the administration of justice

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Willie by gifting him with a complimentary censure.

As we speak (ca. May 2020) Willie practices in Wilson, North Carolina.
