Attorney Josh Van de Wetering of Missoula, MT; ethical ogre

The state of Montana presented Josh Van de Wetering with a law license in 1993 after he graduated from the University of Montana School of Law.

The Office of Disciplinary Counsel of Montana (ODC) found Josh guilty of the following misconduct.

  • Failed to promptly notify client that he was in in receipt of funds of $10,318.00
  • Despite client demands for return of $10,318.00, Josh retained said funds for 8 months and did not return the funds to the client until after the client filed an ethics complaint
  • Failed to keep client informed about status of his funds
  • Failed to continuously maintain a minimum balance of $10,318 in trust account during the period between my receipt of client’s $10,318.00 in funds and disbursement thereof

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Montana Supreme Court punished Josh by gifting him with a complimentary censure.

As we speak (ca. September 2020), Josh practices with the Howard Toole Law Offices at 211 North Higgins Avenue in Missoula, Montana.
