Attorney Dan Sheehan of Albuquerque, NM; ethical troll

 

The state of New Mexico presented Dan Evans Sheehan with a law license in 1972 after he graduated from the University of New Mexico School of Law.

 

The New Mexico Disciplinary Board found Danny guilty of the following misconduct

  • Prior female client was close friend since he was a young boy
  • The client maintained close relationship with Danny until she became mentally incompetent in the early 1990s  
  • Danny was primarily responsible for the client’s care and finances from time her heal began to wane until she was moved to a nursing home shortly before her death in 1996
  • Danny handled her irrevocable trust and also her personal business, extensive investments and medical care
  • In 1982, the client established an irrevocable trust for the benefit of her two grandchildren and Danny was named trust of the trust and essentially served as the only trustee
  • The trust instrument provided for two equal trusts, one to benefit each grandchild
  • Danny never formed separate trusts and distributed almost $30,000 more to the grandson than he did to the granddaughter
  • The trust instrument called for annual accountings; however, Danny only prepared on in more than ten years as trustee
  • Made improper disbursements of trust funds
  • Failed to properly document loans made from trust funds
  • Failed to properly disburse trust funds in accordance with the trust instrument
  • Failed to produce annual accountings and document trust loans
  • Failed to appropriately safeguard funds belonging to their persons
  • Danny violated NNSA 1978 sec, 46-2-3 (loan of trust funds) providing himself with a loan from the irrevocable trust
  • Engaged in conflict of interest when he followed client’s directive to pay cattle company’s legal bills from the irrevocable trust
  • Violated rules on conflicts of interest because the discharge of his fiduciary duties to the irrevocable trust was limited by his own interest in being paid for the legal work he had done for the daughter’s cattle company, and well as by his loyalty and obedience to his client’s directives
  • Consistently charged his client legal fees for services that were predominantly nonlegal in nature
  • Danny charged his client $100 an hour for services such as taking her to the doctor, care providers, to the pharmacy
  • Charged his client an unreasonable fee by charging at lawyer rates for nonlegal services (cheater)

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the New Mexico Supreme Court punished Danny by gifting him with a complimentary deferred 3-year suspension of his law license.

 

In truth, the comedians sitting on the New Mexico Supreme Court didn't mete out any meaningful punishment to Danny.
