Attorney David De Clement of Montclair, NJ; perjurer, repeat offender

 

 

The State of New Jersey provided David Michael De Clement with a law license in 1994 after he graduated from Rutgers University School of Law.

 

The New Jersey Office of Attorney Ethics found Davey guilty of the following misconduct.

Davey’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to safeguard client funds in which client or third party had an interest
  • Released a portion of escrow funds to a party to an escrow agreement without first obtaining the other party’s consent

As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the New Jersey Supreme Court punished Davey by gifting him with a complimentary censure.  

 

Davey’s 2nd bite at the Attorney Misfit Apple Tree

  • Asserted an issue with no basis in law or fact
  • Knowingly made a false statement to ethics investigators (Screw you, said Davey!)
  • Made false statement of material fact or law to a third person
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Committed a criminal act that reflected adversely on his honesty, trustworthiness or fitness as a lawyer
  • Blamed personal misconduct on his secretary
  • Produced false certification, under penalty of perjury, which constituted commission of a criminal act
  • Manipulated state court record

As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the New Jersey Supreme Court punished Davey by gifting him with a complimentary 6-month suspension of his law license.

 

And lastly, because Attorney Misfits in New Jersey are held to a much lower standard of conduct then everyone else, Davey was never criminally prosecuted for perjury.
