Attorney David Hardy of Salt Lake City; serial liar and deceiver

 

The State of Utah provided David J. Harvey with a law license in 1991 after he graduated from the University of Utah School of Law.

 

The Ethics and Discipline Committee of the Utah Supreme Court found Davey guilty of the following misconduct.

  • Engaged in conduct involving dishonesty, fraud, deceit or misrepresentation
  • Failed to file lawsuit on client’s behalf prior to tolling of statute of limitations despite being advised by the client of the date the statute expired
  • Never advised client of failure to file lawsuit prior to statute of limitations tolling
  • Informed his client that the lawsuit had been filed even though he knew it had not
  • When the client followed up with Davey every few months, Davey continued to tell the client that the case was proceeding nicely, even though he
  • knew it was not
  • Davey fabricated details about the case to make it appear to the client that the case was in fact proceeding
  • Davey falsely represented to the client that there was a trial date then a few months later told the client the trial date had been postponed
  • and a new date was in the process of being scheduled, which he knew was false
  • Davey told the client he had filed a motion for entry of default, but no such motion had been filed and Davey knew it
  • Subsequently, Davey took an extra step of creating a document that he captioned “Entry of Default”
  • Davey created the “Entry of Default” document with the intent of making it appear that the document was an authentic court document signed by a clerk of the court, signifying that the Utah resident was in default
  • After creating the fake Entry of Default, Mr. Davey sent the document to the client with the intent of deceiving him into believing that the court had in fact entered a default judgment against the client’s opponent
  • Engaged in a pattern of misconduct
  • Misconduct involved selfish and dishonest motive

As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the Utah Supreme Court punished

Davey by gifting him with a complimentary 1-year suspension of his law license.

 

As we speak, (ca. September 2020), Davey practices at 60 East South Temple in Salt Lake City, Utah.
