Attorney Derek Davis of Dallas, TX; ethical troll

 

The state of Texas presented Derek H. Davis with a law license in 1993 after he graduated from Baylor University School of Law.

 

The District 6 Grievance Committee found Derek guilty of the following misconduct.

  • Entered into a business transaction with clients’ funds wherein he acquired an interest, but the terms were not fair and reasonable to the clients
  • Failed to disclose in a manner understood by clients regarding conflict of interest
  • Failed to advise clients to seek independent counsel re: conflict of interest
  • Failed to obtain written consent from clients re: conflict of interest
  • Failed to adequately safeguard client funds
  • Failed to promptly deliver settlement funds to a client
  • Misrepresented the status of settlement funds when his client inquired about the settlement fund
  • Engaged in conduct involving dishonesty, fraud, deceit, and misrepresentation
  • Misapplication of client funds reflected on his honesty, trustworthiness, and fitness as a lawyer

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Texas Supreme Court punished Derek by gifting him with a complimentary stayed 48-month suspension of his law license.

 

In truth, the cheerleaders for Attorney Misfits sitting on the Texas Supreme Court didn’t mete out any meaningful punishment to Derek.

 

As we speak (ca. March 2020), Derek practices at 96 05 Winding Ridge Drive in Dallas, Texas.
