Judge Stephen Massie of Beckley, WV; ethical dwarf

West Virginia Judicial Investigation Commission found Stevie guilty of the following misconduct

  • Improperly involved himself in pending cases, including a state investigation into his conduct
  • Misused his public office for private gain
  • Allowed social relationships to influence or appear to influence judicial proceedings
  • Abused or appeared to abuse the prestige of his judicial office
  • Appear to undermine his independence, integrity or impartiality in cases between 2014 and 2019
  • Alleged to have lied on numerous occasions
  • Improperly permitted his assistant magistrate, Donny Plumley to accept citation pleas of no contest or guilty from defendants and to set fines based on a sheet Stevie gave him
  • After a church-friend was arrested for assaulting a man with a gun butt and was charged with two counts of battery and one count of brandishing a gun, Stevie went to the police station and intervened to get favorable treatment for his friend
  • Attempted to influence Trooper Mollohan’s testimony to state investigators

Stevie’s Hyperbolic (BS) Defenses

In a lame attempt at levity, Stevie defended the misconduct set forth above by putting forth the following laughable defenses in documents he filed with the Disciplinary Commission.

  • Suggested he was the victim of “religious persecution”
  • Commission did not distinguish between his role as a magistrate and his Constitutional right to freedom of religion
  • “As a servant of God, Mr. Massie abides by the dictates of his religious faith and the teachings of his Lord."
  • "These allegations are suggestive of religious persecution that is designed to deny Magistrate Massie the freedom of religion guaranteed to him by the U.S. Constitution and Article III, Section 15 of the Constitution of the State of West Virginia, rather than a search for truth under the code of judicial conduct."

In response to the allegations of his misconduct, Stevie defended himself in a Facebook post that said, “Satan is busy,” which was a reference to the Judicial Investigation Committee.

All that remains now is to see what if any punishment is meted out to Stevie by the enablers for Judicial Misfits sitting on the West Virginia Supreme Court.

As we speak (ca. December 2019), Stevie continues to sit as a Raleigh County Magistrate Judge in Beckley, West Virginia.
