Attorney David Siebenga of British Columbia, CAN; ambulance chaser, repeater

 

The Law Society of British Columbia presented David Jacob Siebenga with a law license in 1987 after he graduated from the University of British Columbia School of Law.

The British Columbia Law Society Disciplinary Counsel has charged Davie with engaging in the following misconduct.

 

Davie’s 1st bite at the Attorney Misfit Apple Tree

  • Improperly sent an advertising flyer to local realtors offering a free bottle of champagne for every conveyancing referral to his law office by a realtor
  • Improper advertisement featured a drawing of a young woman dressed in an evening gown, also said realtors could win various prizes, including “two beautiful hostesses to assist at one open house
  • Improperly asked people to direct clients to his office in return for a reward
  • Failed to act in the best interests of the public
  • Failed to maintain high standard of professionalism

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Disciplinary Board punished Davie by gifting him with a complimentary reprimand and a $2,000 fine.

 

Davie’s 2nd bite at the Attorney Misfit Apple Tree

  • Engaged in conflict of interest
  • In property transaction, represented the purchaser and the bank without disclosing each party’s interest to every other party to the transaction
  • Failed to disclose that the purchaser was buying and immediately reselling the property, and making a profit from that resale

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Disciplinary Board punished Davie by gifting him with a complimentary reprimand and a $3,000 fine and assessed costs of $2,500.

 

Davie’s 3rd bite at the Attorney Misfit Apple Tree

  • In first court action on client’s behalf, filed affidavits stating his client had no legal or beneficial interest in a piece of property
  • In another court action, took the position that his client had an equitable interest in the same piece of property
  • Engaged in conduct prejudicial to the administration of justice
  • Supreme Court judge held Davie’s conduct was an abuse of court process and awarded specials costs against him of $6,000

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Disciplinary Board punished Davie by gifting him with a complimentary 30-day suspension of his law license and assessed costs of $6,172.50.  

 

Davie’s 4th bite at the Attorney Misfit Apple Tree

  • Misappropriated (stole) client trust funds totaling $25,575.93
  • Able to misappropriate clients funds on 290 occasions by reversing trust checks, some or all of which were stale-dated and subsequently withdrawing the funds in payment of purported fees and disbursements, when she knew or ought to have known that those fees or disbursements were not properly charged to her clients
  • Mislead Law Society by proving information and records she knew were false or misleading
  • Produced some or all of 214 statements of account bearing dates between September 26, 2008 and November 30, 2011, and by referring to and relying on the statements of account when she knew or ought to have known that the statements of accounts were back dated
  • Provided trust report to Law Society certifying it to be “true and correct” that her office did not have outstanding stale-dated checks issued from her trust account when she knew that answer to be false
  • Failed to comply with mandatory accounting obligations
  • Commingled client funds with personal funds

All that remains now is to see what if any punishment is meted out to Davey by the enablers for Attorney Misfits sitting on the Disciplinary Counsel regarding his 4th bite at the Attorney Misfit Apple Tree.
