Attorney Benjamin Horton of Salt Lake City; cheating slacker

 

The State of Utah presented Benjamin R. Horton with a law license in 2007 after he graduated from Brigham Young University (BYU) School of Law.

 

The Ethics and Discipline Committee of the Utah Supreme Court found Benny guilty of the following misconduct.

  • Failed to act with due diligence (slacker)
  • Failed to communicate with clients
  • Charged and/or collected an unreasonable fee (cheater)
  • Failed to properly supervise office staff
  • Engaged in conduct involving dishonesty, fraud, deceit or misrepresentation
  • Failed to fully cooperate with ethics investigators (Screw you, said Roland!)
  • Failed to respond to client information requests
  • Failed to keep client informed of status of application for loan modification
  • Failed to provide any meaningful legal services to the client in exchange for the fees paid
  • Improperly shared legal fees with non-lawyer
  • Failed to take adequate steps to ensure the client obtained independent representation in connection with the engagement agreement
  • Failed to advise the client to seek independent legal review of the liability waiver included in his engagement agreement

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court punished Benny by gifting him with a complimentary 3-year suspension of his law license.

 

As we speak (ca. July 2019) Roland practices at 2825 East Cottonwood Parkway in Salt Lake City, Utah.
