Attorney Kevan Migneault of Saskatchewan, CAN; ethical troll

The Law Society of Saskatchewan presented Kevan M. Migneault with a law license in 1998 after he graduated from the University of Saskatchewan School of Law.

The Law Society of Saskatchewan Disciplinary Committee found Kevan guilty of the following misconduct.

  • Engaged in conduct unbecoming an officer of the court (Pray tell!)
  • Failed to act with due diligence (slacker)
  • Negligently facilitated the commission of a fraud or frauds by a client
  • Did,  through  willful  blindness  or  recklessness,  facilitate  the  commission  of  a  fraud, or frauds, by his client
  • Did  knowingly  facilitate  the  commission  of  a  fraud,  or  frauds,  by  his  client
  • Did allow himself to become the dupe of an unscrupulous client
  • Did  enable client to  achieve  an  improper  purpose  by  using  his  law  firm  and  status as a lawyer to legitimize fraudulent activities
  • Failed to maintain proper books and records for his legal practice
  • Withdrew funds  from  trust  in  payment  of  fees  and  disbursements  in  manner not  authorized  by  Law  Society
  • Did, in relation to client matter, use trust funds held on behalf of the client for a purpose other than which the client intended; namely, a personal loan in the amount of $61,217.50 made by Kevin to a third party
  • Did  enter  into  or  continue  a  debtor/creditor  relationship  with several clients (loaning money) when his interests and the interests of those clients were in conflict
  • Mislead   the   Law   Society   of   Saskatchewan by filing annual practice declarations stating that he had not loaned money to clients in those years when he knew that to be false (Up yours, said Kevin!)
  • Did,   through   willful   blindness   or   recklessness,   involve   himself   in   the   investment  offerings  of  his  client and  his  affiliated  corporations,  to  the  general  public  when  the client and  his  affiliated  corporations  were  the  subject  of  a  Cease Trade Order
  • Charged interest rates of 21% and 27% on loans he made to his clients

As a direct consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Upper Law Society Committee punished Kevan by gifting him a complimentary reprimand.

As we speak (ca. April 2019), Kevan practices with Migneault Greenwood at 1391 101st Street in North Battleford, Saskatchewan, Canada.
