Judge Amy Pellman of Los Angeles; incompetent boob

The state of California presented Amy M. Pellman with a law license in 1992 after she graduated from the City University of New York School of Law.  

Former Gov. Arnold Schwarzenegger was duped into appointing Amy as a Los Angeles County Superior Court judge in 2008. Amy didn’t receive the appointment because she was the most qualified attorney in the Los Angeles area. She received it because she had proven to be a reliable lackey for the local political hacks.

In one matter, Judge Pellman presided over a case involving a domestic violence restraining order she imposed on Encino lawyer Michael M. Molinaro to the extent that it prohibited him from posting any about his divorce case on Facebook.

Subsequently, Mr. Molinaro appealed Amy’s asinine ruling to the Court of Appeal. In reversing Amy’s order to silence Mr. Molinaro, the court said in part.

• “Although we have found the evidence sufficient to support the court’s issuance of a domestic violence restraining order, we conclude the part of the order prohibiting Michael from posting ‘anything about the case on Facebook’ is overbroad and impermissibly infringes upon his constitutionally protected right of free speech.’”

The Court of Appeals continued with its reversal by saying:

• “Orders enjoining the right to speak on a particular topic are disfavored and presumptively invalid….However, courts have recognized a prior restraint may be permissible under certain limited circumstances….”
• “To establish a valid prior restraint under the federal Constitution, a proponent has the heavy burden to show the countervailing interest is compelling, the prior restraint is necessary and would be effective in promoting this interest, and less extreme measures are unavailable.”

How incompetent does one have to be to not appreciate and/or comprehend the legal meaning of the free speech mandates of the 1^st Amendment to the Constitution?

It goes without saying that Amy doesn’t much give a damn when she’s overturned (rebuked in truth) by the appellate court since she is well aware that no California judge has ever been tossed off the bench for being incompetent.

As we speak (ca. April 2019) Amy continues to sit as a Los Angeles County Superior Court judge in Los Angeles, California.
