Re: Filing of False Personal Financial Statements re: Gifts

Dear Mr. Cox:

Below are facts proving that Lt. Gov. David Dewhurst and several state legislators have violated Texas criminal statutes in filing false personal financial statements. Those annual statements specifically deal with the named miscreants falsely affirming under oath that they did not receive any gifts. This appears to be the same type of felonious conduct that Rep. Kino Flores was successfully prosecuted for by your office.

I don’t profess to be a legal maven, therefore as to whether the applicable criminal statute of limitations may have tolled on any of these acts I cannot comment. I’m more than confident that your office is more than competent to address this issue.

The names of the office holders are set for the below. Below the names listed you’ll see the specific the specific amounts of the gifts, the person/entity that provided the gifts and non-disclosure of same.

As to Lt. Gov. David Dewhurst, you’ll see that I added two gifts for prior years from John Whitmire despite the fact that I have not been able to access his financial statements for those years. Since he failed to disclose a 2007 gift from Whitmire, he may well have failed to disclose these as well.

As it relates to Rep. Armando Martinez and Eddie Lucio III, they were both named as receiving a total of $746.94 for gifts for having babies from Rep. Rene Oliveira. I can’t determine if they were duplicate gifts or the exact amount for each; however, they both appear to be in excess of $250.00.

I have also included to gifts from Eliot Shapleigh and Friends of Bob Deuell as to gifts for unnamed Committee Chairs. I’m sure you have the expertise to discover who

I believe there are more officeholders involved in this type of conduct; however, as you can imagine it is a daunting task to perform the necessary research. As time permits, I will forward you any additional information regarding this or other type of conduct that I believe should be forwarded to your attention.
the recipients of these gifts were and if they disclosed same.

I am forwarding a copy of this complaint to Mr. David Reisman, Executive Director of the Texas Ethics Commission.

If there is any other information you need, please feel free to contact me.

Thanks for your time and attention to this serious matter.
