Attorney Joshua Simms of Albuquerque, NM; ethical goblin

The state of New Mexico presented Joshua R. Simms with a law license in 1992 after he graduated from the University of New Mexico School of Law.

The New Mexico Disciplinary Board found Josh guilty of the following misconduct.

• Knowingly failing to provide competent representation to clients
• Knowingly failing to ascertain and abide by clients’ decisions concerning the objectives of representation
• Failed to act with due diligence (slacker)
• Knowingly representing numerous clients without obtaining their informed consent to do so in the face of one or more concurrent conflict(s) of interest between the clients and the interests of a third party
• Knowingly accepted compensation for representing numerous clients from one other than the clients without obtaining informed consent from the clients
• Failed to deposit advance fees into client trust account
• Failed frivolous lawsuit with no basis in law or fact
• Shared legal fees with non-lawyer
• Knowingly permitted persons affiliated with a third party to direct or regulate his professional judgment in rendering legal services
• Knowingly engaging in conduct involving dishonesty and misrepresentation
• Engaged in conduct prejudicial to the administration of justice

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the New Mexico Supreme Court punished Tommy by gifting him with a complimentary 18-month suspension of his law license effective August 2, 2017.

As we speak (ca. October 2018) Josh practices in Albuquerque, New Mexico. His license will be reinstated on or about January 2019.
