Judge Diane Price of Napa, CA; moronic loser

The state of California presented Diane M. Price with a law license in 1958 after she graduated from the University of California Hastings School of Law.

Former Gov. Arnold Schwarzenegger was duped into appointing Diane as a Napa County Superior Court judge in 2006. Diane didn’t receive the appointment because she was the most qualified attorney in the greater Napa area. She received it because he had proven to be a reliable lackey for the local political hacks.

In one matter, Diane presided over a case involving hospital nurse Carolyn Staats who sued Vintner’s Golf Club LLC after she was attached by a swarm of yellowjackets while playing golf. Ms. Staats was bitten about 50 times and nearly died. Her lawsuit v. Vintner’s was based on premises liability.

In her infinite ignorance, Diane granted summary judgement to Vintner’s based on its laughable claim of its “lack of knowledge” of “swarming yellow jackets or subterranean yellow jacket nests on the golf course fairway.”

Subsequently, Ms. Staats filed an appeal with the First District Court of Appeal regarding Diane the Moron’s summary dismissal of her lawsuit.

In reversing Diane’s idiotic ruling, the Appellate Court stated in part:

• “We hold that the duty of golf course operators to maintain their property in a reasonably safe condition includes a duty to exercise reasonable care to protect patrons from nests of yellow jackets on the premises.”
• “The measures a golf course operator must take to satisfy this duty may vary, and we do not address whether the Club breached its duty, or whether any such breach caused Staats’s injuries.”
• “Here, those questions involve unresolved issues of material fact that must be determined by the trier of fact [jury] in the first instance.”

In short, the Court stated that issue of negligence and liability was a factual issue for a jury to determine not a matter of law for a judge to determine. This is something a first year law student would learn.

The Court went on to note that yellowjackets are common in Northern California by stating:

“Because we must assess whether the presence of nests on a golf course creates a general risk of foreseeable injury—i.e., the possibility that yellow jackets will swarm and attack a golfer—we find it of marginal importance that the Club claims it was unaware of any previous swarm or sting.”

Of course Diane the Dumbo (DD) doesn’t much give a damn about being spanked on reversal by the Court of Appeal because no judge in California has ever been tossed from the bench by the Judicial Commission for being a Moron.

As we speak (ca. November 2018), Diane continues to sit as a Napa County Superior Court judge in Napa, California.
