Attorney James Barry of Muscatine, IA; serial scofflaw, repeat offender

 

The state of Iowa presented James Patrick Barry with a law license in 1987 after he graduated from Washington University Law School.

 

The Iowa Supreme Court Attorney Disciplinary Board found Jimmy guilty of the following misconduct, all of which occurred while he was employed as an Assistant Cass County District Attorney.

 

Jimmy’s 1st bite at the Attorney Misfit Apple Tree

  • Knowingly made a false statement of material fact
  • Participated in the creation of or preservation of evidence when it was obvious he was aware it was false
  • Counseled or assisted a client in conduct that he knew was illegal or fraudulent
  • Instituted or caused to be instituted criminal charges when he knew, or it was obvious that the charges were not supported by probable cause

As a direct consequence of his misconduct, the Cheerleaders for Attorney Misfits sitting on the Iowa Supreme Court punished Jimmy by gifting him with a complimentary reprimand.

 

Jimmy’s 2nd bite at the Attorney Misfit Apple Tree

  • Continued to practice law despite prohibition against so acting after becoming a full time assistant prosecutor
  • Knowingly and with a purpose to do wrong breached his duties as a prosecutor
  • Violated the law when he allowed a defendant to pay her fine by donating $400 to the Cass County sheriff’s office in lieu of performing community service
  • Violated the law when a defendant was allowed to pay $500 to the Cass County sheriff’s office for the return of his pickup truck that was seized as a result of various drug felony charges
  • In numerous cases, Jimmy illegally directed defendants to pay several hundred dollars to the Cass County sheriffs’ office in return for a lighter sentence and/or as an alternative to the normal sentence that should have been imposed
  • Engaged in conduct prejudicial to the administration of justice
  • Engaged in conduct adversely reflecting on fitness to practice law
  • Knowingly engaged in illegal conduct or conduct contrary to a disciplinary rule

As a direct consequence of his misconduct, the Cheerleaders for Attorney Misfits sitting on the Iowa Supreme Court punished Jimmy by gifting him with a complimentary 1-year suspension of his law license.

 

As we speak (ca. October 2018) Jimmy is employed as the Project Manager with Hoffmann Inc. at 6001 49th Street South in Muscatine, Iowa.
