Attorney John Peck of Wilmington, NC; ethical goblin, serial offender

 

The state of North Carolina presented John J. Peck with a law license in 1981 after he graduated from the University of North Carolina Law School.

 

The Grievance Committee of the North Carolina State Bar found Johnny guilty of the following misconduct.

 

Johnny’s 1st bite at the Attorney Misconduct

  • Failed to cooperate with ethics investigators (Up yours, said Johnny!)
  • Improperly destroyed evidence of renter’s client
     

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Johnny gifting him with a complimentary reprimand.

 

Johnny’s 2nd bite at the Attorney Misconduct

  • Engaged in egregious conflict of interest re: two clients
  • Failed to list name of client from whose trust account balance payment of his fees and/or expenses was drawn on the fact of trust account checks made payable to Johnny

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Johnny gifting him with a complimentary reprimand.

 

Johnny’s 3rd bite at the Attorney Misconduct

  • Engaged in egregious conflict of interest re: two clients with conflicting interests
  • In agreeing to provide estate and Medicaid planning services to elderly client with profound dementia and his wife when he knew their interests conflicted
  • Prepared documents for the diminished-capacity client to sign based entirely on consultation with the wife and step-daughter
  • Failed to obtain written confirmation of any party’s consent to the potential conflict of interest inherent in the representation

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Johnny gifting him with a complimentary reprimand.

 

As we speak (ca. February 2019) Johnny practices at 428 Eastwood Road in Wilmington, North Carolina.
