U.S. Judge Alan Gold of Miami; one of the Good Guys

 

The state of Florida presented Alan Stephen Gold with a law license in 1974 after he graduated from the University of Miami Law School.

 

In one matter, Judge Gold presided over a criminal prosecution of Dr. Ali Shaygan accused of issuing unwarranted prescriptions for painkillers.

 

In a 50-page opinion in the case, Judge Gold reprimanded United States Attorney R. Alexander Acosta, his top aides and three other prosecutors for withholding evidence and violating procedures in pursuing the case against Dr. Shaygan. In his written opinion, Judge Gold said in part:

 

Prosecutors “exhibited a pattern of 'win-at-all-cost' behavior in the conduct of this investigation that was contrary to their ethical obligations as prosecutors and a breach of their 'heavy obligation to the accused.'"

 

In addition, Judge Gold ordered the government to pay more than $600,000 in fees and costs incurred by Dr. Shaygan.

 

The criminal trial of Dr. Shaygan led to his acquittal; however, it was discovered at the trial that two prosecution witnesses that were presented as neutral patients (unbiased) of Dr. Shaygan were in fact cooperating with the government and were previously authorized to make recordings of Dr. Shaygan’s defense attorney and the attorney’s investigator.

 

Judge Gold stated that he was going to alert the State Bar of the misconduct of Acosta and his subordinates.

 

Kudos to Judge Gold for having the courage and fortitude to call out these types of overzealous prosecutors who will do anything for a victory for the purpose of placing another notch on their wrongful conviction belt.

 

As we speak (ca. November 2017) Judge Gold continues to sit as a U.S. District Court Judge in Miami, Florida.
