Judge David Bender of Washington C.H., OH; ethical goblin

The state of Ohio presented David Bryan Bender with a law license in 1986 after he graduated from the University of Toledo Law School.

In one matter, Bender presided over a legal guardianship case involving a 21-year-old man who was left with traumatic brain injury from a motorcycle injury. The guardianship matter pitted the young man’s mother against her daughter and her parents.

The parents were wealthy and are alleged to be friends with Judge Bender, with Bender the recipient of various sums of money from the parents over the years. In addition, it is alleged that prior to ascending to the bench, Bender represented the parents in a case that involved the mother of the inured 21-year-old man.

Despite the obvious conflict of interest in presiding over a guardianship matter involving a prior client, Bender refused to recuse (remove) himself from the case even though the Code of Judicial Conduct mandated that he so act.

As one would suspect, Bender issued a ruling favoring his prior clients, the parents when he named the 21-year-old’s sister as his guardian rather than the mother even though the sister lived at least three hours away and had a job that involved frequent out-of-state travel.

Bender’s highly questionable conduct has led to the mother now being unable to see her disabled son. Bender claims that he does not possess the power to assure that the mother can visit her son, a claim that doesn’t pass the involuntary laugh test.

This is exactly the kind of justice one can expect when someone of Bender’s ilk is appointed to the bench for purely political reasons.

And lastly, it is unfortunate that Judge Bender is in the business of “dispensing with justice” rather than actually “dispensing justice.

As we speak (ca. October 2017), Bender continues to sit as the Fayette County Probate and Juvenile Court judge in Washington Court House, Ohio.
