Attorney Darryl Smith of Wilson, NC; repeat offender

The state of North Carolina presented Darryl G. Smith with a law license in 1977.

The Grievance Committee of the North Carolina State Bar found Darryl guilty of the following misconduct.

Darryl’s 1^st bite at the Attorney Misfit Apple Tree

• Failed to cooperate with ethics investigators (Up yours, said Darryl!)
• Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
• Failed to obtain prior consent from ex-wife to file joint IRS tax return

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the North Carolina State Bar punished Darryl by gifting him with a complimentary reprimand.

Darryl’s 2^nd bite at the Attorney Misfit Apple Tree

• Misconduct involved multiple offenses
• Failed to refund monies owed to client
• Failed to comply with trust accounting rules
• Failed to promptly inform client of funds owing to client
• Failed to deposit client funds into client trust account
• Failed to provide written accountings to clients
• Failed to identify client on all deposits and wire transfers
• Failed to maintain accurate account ledger for each client

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the North Carolina State Bar punished Darryl by gifting him with a complimentary stayed 3-year suspension of his law license.

In truth, the comedians sitting on the State Bar Disciplinary Board didn’t mete out any meaningful punishment to Darryl.
