Today’s “Judicial Misfit” Award Winner
On Feb 16, 2011, oral arguments were held before the Ohio Supreme Court in regards to the egregious misconduct of attorney David Romaine Pheils, Jr. of Toledo.
Attorney Phiels’ peers in the greater Toledo, Ohio area have consistently adjudged him to be the most corrupt attorney to have ever been gifted with a law license by the Ohio Supreme Court. To be excruciatingly fair to Mr. Pheils as is my wont, he has received stiff competition as the No. 1 crooked attorney in Toledo from his associate and mentor E. J. Leizerman. Put simply, they are and have been (ca. 1980-2011) the Twin Towers of Evil!
During oral arguments, Chief Justice Maureen O’Connor let it be known in no uncertain terms that she was not persuaded by the hyperbolic (BS-Sham) arguments put forth by Pheils’ attorney-partner Marshall D. Associate Justice Paul Pfeifer, on the other hand, inexplicably appeared to be stammering and pandering in an effort to protect the interests of the miscreant Pheils instead of impartially sitting in judgment and critically analyzing the sworn testimony of a lawyer who openly claims to be a millionaire but who also claims to have no banking records.
Worse yet, the Toledo Bar Association was negligent and even reckless in their alleged investigation of Pheils by not pursuing this case with all the skill and professional expertise that the public should expect from such an organization whose mission is to protect the public from dishonest lawyers. If you examine this hearing in even cursory detail you will have to conclude that both the TBA and Pfeifer were simply going through the motions. And speaking of pandering, does anyone with a brain not believe that the “independent wife” defense employed by Pheils had a target audience of the women who sit on the Ohio Supreme Court?
Above all, it is they should be insulted and make short work of this tripe because what this grandfatherly appearing but long time crooked lawyer is really doing is hiding behind his wife to save his own skin. Hopefully some Justice will point that obvious fact out in the opinion, but I’m betting that it won’t be Pfeifer.

One could reasonably conclude from Justice Pfeifer’s conduct during oral arguments that he was (a) being paid an hourly fee by Pheils as co-counsel and/or (b) that Phiels personally incurred the expense to purchase a pair of “industrial strength knee pads for him.
Prior to the hearing, Justice Pfeifer was intimately aware of Pheils’ prior conduct of defrauding his clients. In fact, in the past Pfeifer specifically ruled that the following conduct by Pheils was consistent with the ethical obligations of attorneys practicing in Ohio.
The above are but a few examples of the fraudulent claims for attorney fees that Justice Paul Pfeifer ruled were not only reasonable but were absolutely necessary. Can it be disputed that Justice Paul Pfeifer is a die-in-the-wool enabler for crooked attorneys?
Congrats Justice Pfeifer; keep up the good work! We should let your constituents all know of your unethical efforts in acting as an enabler for crooked lawyers.
