Justice 
Justice Carols Calderon unfortunately has sat as a Justice on the Milton Town Court in Ballston Spa, New York, which is about 30 miles north of Albany since January 2006.
Prior to assuming the throne, Calderon was a New York State trooper.
In October 2008, the Judicial Commission filed an ethics complaint against Calderon and in March 2010 the Commission found him guilty of the misconduct resulting from a Feb 2005 auto accident involving Calderon while he was a state trooper involved in a high-speed chase involving Octavio Rivera.
Mr. Rivera was later charged with numerous crimes including robbery, drunk driving and assault. At Rivera’s criminal trial, Calderon testified and was cross-examined by Rivera who acted as his own attorney. Rivera was sentenced to 15 years and hauled off to Sing Sing.
Prior to Rivera being sentenced, Calderon was asked to submit a “”victim impact statement” which he did. He was specifically advised that a copy would be provided to Rivera since he didn’t have an attorney. In this statement, Calderon stated he did not suffer any “emotional injury” from the accident.
Calderon subsequently retired from the State Police in part because of the injuries he sustained when Rivera collided with him.
In April 2007, Calderon filed a lawsuit against Rivera, claiming he suffered physical injury and “mental anguish” as a result of the collision. Calderon was represented by an attorney.
After Rivera was served with the lawsuit at Sing Sing, he sent a discovery request to Calderon requesting that he admit that the statements in his victim impact statement were true. Not only did Calderon refuse to comply with New York court rules and answer the request from Rivera, his so-called lawyer did the same thing.
Subsequently, and while he was serving as a judge, Calderon contacted officials at Sing Sing and demanded that they confiscate the copy of his victim impact statement that was lawfully in Rivera’s possession and to prohibit from any further written communications with Calderon.
During these oral and written communications, Calderon went out of his way to make sure the prison officials were aware of his status as a Judge by submitting his writings in an envelope marked Milton Town Justice.
Il Duce’s conduct was abhorrent in that he attempted to use his judicial position to perpetrate a scam on prison officials. Even more disturbing is Calderon’s admission in his impact statement that he did not suffer any “emotional injury,” which clearly renders his claim that he did in his lawsuit a total sham, lie and fabrication. Of course his so-called ambulance chasing attorney knew it was a sham before he filed the frivolous claim.
The enablers on the Commission punished this total loser and liar by gifting him with a complimentary censure. As we speak (ca. Feb 2011) this loser remains on the bench. How laughable is this?
