Today's Public Official Misfit: DA Jennifer Dorsey of Corpus Christi

 

The state of Texas presented Jennifer Paige Honey Dorsey with a law license in 2002 after she graduated from the University of Houston Law School.

 

Jenny’s misconduct took while she was the Nueces County District Attorney in Corpus Christi, Texas.

 

In one matter, Jenny was assigned to prosecute a murder case involving Anthony Macias’ killer, which ultimately led to his conviction after a jury trial.

 

Immediately after the jury returned its guilty verdict, Jenny turned to the victim’s family that was sitting in the courtroom galley and gave a firm nod. The family’s feeling of relief took a sharp turn ten weeks later when a judge tossed out the guilty verdict because of prosecutorial misconduct involving Jenny.

 

State District Court Judge Nanette Hasette reversed the murder conviction of Courtney Hayden and granted her a new trial. In her reversal ruling, Judge Hasette said:

 

“The concludes that the intentional suppression of evidence and lack of timely disclosure of exculpatory, mitigating and impeachment evidence described herein constitutes prosecutorial misconduct and undermines the confidence of the public in the judicial system, and the outcome of this trial specifically.”

 

Of course if Macias’ killer is guilty he surely deserves at least a life sentence; however, he also deserved to be the recipient of a fair trial in accordance with accepted Supreme Court rulings. Those rulings clearly mandate that a prosecutor turn over any and all exculpatory evidence (tending to prove innocence) to the defense, which Jenny clearly did not do.

 

Jenny could face possible criminal charges for his violation of evidence disclosure laws; however, this is highly unlikely given that it would be one of her counterparts that would have to so act. Additionally, she could face ethics charges with the State Bar, but if that happens at worst the enablers sitting on the Texas Supreme Court would provide her with a complimentary reprimand.

 

As we speak (ca. May 2016) Jenny continues to be employed as an Assistant Nueces County District Attorney in Corpus Christi, Texas.
