Judge William Foust of Milwaukee; one of the Good Guys

 

Judge Faust was assigned to hear a case involving the AFL-CIO, the International Association of Machinists and the United Steel Workers in a lawsuit filed against the state of Wisconsin that passed a law banning unions from charging union dues to non-union workers.

 

Gov. Scott Walker and his right-wing, anti-worker comrades in the State Legislature, passed a so-called right-to-work law that prohibited unions from collecting union dues from employees who refused to join the union. However, the discriminatory law permitted the non-paying dues members to financially benefit from union efforts to increase wages and fringe benefits.

 

Arguing that someone should benefit financially by receiving services they never paid for is patently unconstitutional. This absurd law would be akin to the following:

  • Wisconsin Teachers Union pays for rounds of golf at Erin Hills Golf Course
  • ErinHillsGreen Fees ($265) are paid for out of union dues
  • Teachers can opt to not join the union
  • Opting out means teachers don’t pay union dues
  • Per Gov. Walker: non-members entitled to free golf at Erin Hills       

It should be noted that Erin Hills Golf course in Erin, Wisconsin will be hosting the 2017 U.S. Open.

 

Luckily for the hard working union workers in Wisconsin, Judge Foust recently (early April 2016) ruled that Gov. Walker’s anti-union law was “unconstitutional.”

 

Kudos to Judge Foust for having the courage and fortitude to rule that Gov. Walker’s union-busting law violated the U.S. and Wisconsin constitutions.

 

As we speak (ca. April 2016) Judge Foust continues to sit as a Dane County Superior Court judge in Milwaukee, Wisconsin.
