Who will be Scalia's replacement if Hillary wins in 2016?

 

After Justice Antonin Scalia’s recent (ca. February 2016) death, Sen. Mitch McConnell, leader of the Senate stated he would not allow an Obama nominee to proceed to a confirmation vote. This is what I call democracy in action. Of course true democracy as the Founding Fathers intended, would be to allow Mitch to select and appoint Scalia's replacement. 

 

He went on to laughingly state that we should wait until the 2016 presidential election so that the voters can be heard on the subject. Of course the voters did speak quite loudly in 2012 when they overwhelmingly reelected Obama.

 

Immediately after McConnell’s promise of no Obama confirmation, numerous other GOP senators and all of its presidential nominees sang the same chorus.

 

Such obstructionism will mean that Scalia’s vacancy on the court will be filled at the earliest in February 2017 and that will only happen if a Republican is elected president. This is what I call democracy in action.

 

Now, if Hillary is elected president and the Republicans retain control of the Senate, we can be assured that Sen. McConnell will not allow her to fill Scalia’s seat for the next four years (2017-2021).

 

If Hillary were to be reelected to a second term in 2022 and the GOP continued to control the Senate, and Mitch again refused to allow her to fill Scalia’s seat, this would mean his seat would remain empty for well over nine (9) years.

 

And of course if this same scenario occurred in the 2026 (Democrat wins Presidency) and was reelected in 2030, then we’d be looking at nearly 18 years passing without Scalia’s seat ever being filled.

 

Now, I don’t know aobut you, but this certainly doesn’t appear to be the way true democracy is practiced.

 

Maybe its time to just allow the highest bidder the exclusive right to appoint whomever he/she sees fit on the Supreme Court. If the bid is $100 million, then the money could be used to pay down the national debt. Who knows, the billionaire class could pool their money and bid $1 billion or even more for the seat.
