09/03/10 – Ohio Supreme Court ethics complaint v. Judge Stephen Yarbrough
Below is a verbatim copy of an ethics complaint sent via email and snail mail to Jonathan Coughlan, Chief Disciplinary Counsel for the Ohio Supreme Court.

Re: Serial Frauds perpetrated by Judge Stephen Yarbrough
Dear Mr. Coughlan:
The evidence of the serial frauds engaged in by Judge Yarbrough is too voluminous to address herein. Therefore I have opted to incorporate as if fully rewritten herein the evidence contained within the URLs listed below.
As you’ll see it is undisputed that Yarbrough has consistently billed for hours never worked and/or for travel expenses he factually did not incur. He cannot be heard to defend his conduct as mere error given the magnitude, number and repetitive nature of these ongoing frauds. To so argue would not pass the involuntary laugh test.
I believe your office should immediately seek the immediate removal of Yarbrough in order to protect the public from further frauds.
In June 2008, the California Judicial Commission ordered the removal of Orange County, California Superior Court Judge Kelly MacEachern for similar conduct, which can be viewed at: http://tinyurl.com/26qc4dn. Admittedly, Judge MacEachern’s conduct pails in comparison to the serial frauds engaged in by Yarbrough over the past 10 or more years. Put simply, Judge MacEachem is a piker when it comes to bilking the public in comparison to Judge Yarbrough!
I can if you wish, provide you with even more cases wherein State Supreme Courts have removed judges for bilking the public by billing for hours they never worked and/for expenses they did not incur and/or personally pay for. Please let me know if you like for me to forward this information on to you.
It would be difficult to imagine a scenario wherein a judge engaged in this type of aberrant behavior over such a long period of time for the sole purpose of unjustly enriching himself at public expense.
To allow Judge Stephen Yarbrough to retain his law license would be a slap across the face to every honest judge or attorney in the State of Ohio who acts in accordance with the Codes of Judicial Conduct and Professional Responsibility.
With all due respect, every day that Judge Yarbrough is allowed to retain his license can only be construed as de facto defamation of the entire legal profession in Ohio.
Please provide me with a copy of Judge Yarbrough’s response to this complaint.
