Judge Thomas Foulds of Toronto, CAN; ethical leprechaun

 

In one matter,Tommy found it acceptable to get involved in a case involving an old friend’s operation of a restaurant called Didier located in downtown Toronto.

 

The fancy midtown French restaurant was closed for failing to maintain the premises free of sewage backup on a particular Friday night. Tommy had asked the restaurant owner to keep him in the loop and was present during the re-inspection that took place the following evening.

 

Tommy told two health inspectors that he was there to help interpret for the restaurant owner, though all the conversation took place in English. One of the inspectors recognized Tommy as a justice of the peace, having appeared before him in court on public health matters in the past.

 

The inspectors conclude that the sewage backup problem had been corrected and allowed the restaurant to reopen. However, the DineSafe pass that is required to be displayed notified customers that the restaurant had been closed for the sewage backup problem.

 

Tommy then asked the inspectors to remove the mention of the closure; something that he absolutely knew was in contravention of city DineSafe regulations. Tommy told the inspectors Didier was hosting an important Liquor Control Board of Ontario (LCBO) party the following Monday, and that thousands of bottles of wine would be purchased. Tommy said he would be attending the even along with friends and colleagues and did not want any of them to see the result of the last health inspection.

 

The health inspector who recognized Tommy as a Justice of the Peace said that he felt “intimidated and nervous.”

 

As a consequence of his misconduct, the enablers for Judicial Misfits sitting on the Justice of the Peace Panel punished Tommy by gifting him with a complimentary 7-day suspension from the bench. 

 

And lastly, Tommy conducts himself in accordance with the old adage “A friend in need is a friend indeed,” rather than the mandates of his oath of office.

As we speak (October 2015), Tommy continues to sit as a Justice of the Peace on the Justice of the Peace court in Toronto, Canada.
