Judge David Near of Ottawa, Canada; loser, lifetime porker

David G. Gear was unfortunately provided with a law license in 1983 after he graduated from the University of Windsor Law School.

After working for about 2-years in the private sector since 1983, David has spent the next 29 years with his snout significantly planted in the public trough. In 2009, David succeeded in duping the powers-to-be into appointing him as a judge on the Federal Court of Appeals in Ottawa, Canada.

David wasn’t appointed to the Federal Court of Appeals because he was the most qualified; he was appointed because he earned it by acting as a compliant lackey for the local political hacks.

The Canadian Judicial Council found Judge Near guilty of the following misconduct.

In one matter, Dave the Porker found it acceptable to sit on a case involving the federal government despite the fact that he worked for same governmental entity in the past. Put simply, Judge Near was intellectually incapable of determining that he was involved in a blatant conflict of interest.

As one would suspect, Richard Scott, Chief Justice of Manitoba and Chairperson of the Judicial Conduct, and Chief Enabler for Judicial Misfits had the chutzpah to find that Near did not engage in any misconduct.

Is it any wonder why most Canadians have absolutely no respect for the manner in which Justices and Judges are investigated for misconduct?

The same asinine result could be expected if jurors in a child molestation case were limited to convicted pedophiles.

As we speak (ca. August 2015), Near sits as a judge on the Canadian Federal Court of Appeals
