Attorney Joseph Bamberger of Boone County, KY; scofflaw, ethical wretch

 
For twenty-two years, (ca. 1991-2003) Joseph Bamberger was a sitting judge on the Boone County Circuit Court.
 
Scam involving Fen-Phen lawsuit (aka, Fen-Fen-Fun)
 
In late 1999 or early 2000, a class action lawsuit was filed in Bamberger’s court against the manufacturer of the diet drug Fen-Phen.
 
In 2001, a settlement for $200 million was reached between the class action plaintiffs and American Home Products, manufacturer of Fen-Phen.
 
Judge Bamberger approved attorney fees totaling at least $86 million and as much as $104 million while the injured plaintiffs collected a total of about $74 million.
 
Not satisfied with screwing the class action plaintiffs by awarding his attorney friends nearly 50% of the settlement, Bamberger then approved the following thefts from the $200 million settlement.
  • $2 million for his close friend, trial consultant Mark Modlin
  • $20 million to be placed in a charitable fund
  • $5,000 a month stipend to Bamberger as a director of the fund + $350 monthly expense allowance
  • $6,500 monthly stipend + $1,000 monthly expense allowance for his friend Mark Modlin
  • $5,000 monthly stipend + $350 monthly expense allowance for the three crooked attorneys that represented the class action plaintiffs.
Before this outrageous scheme was uncovered, Judge Bamberger netted at least $45,000 via his appointment as a director of the $20,000 million charitable fund
 
Conclusion
 
How is it possible that this celebrated louse was allowed to retain his law license? Here’s a clown (my apologies to clowns) that schemed with his attorney-friends to rip-off their clients by absconding with well over 50% of a settlement and then had the chutzpah to pay himself $5,000 a month out of the settlement and another $22,000 to his crooked attorney friends.
 
This is solid evidence that Judicial Misfits are held to a lower standard of conduct then we are. After all, they’re egregious misconduct is judged by other Judicial Misfits, right?
 
Attorney Joseph Bamberger now practices law in Florence, Kentucky which is in the greater Cincinnati area.
