Should Cleveland Plain Dealer seek removal of Judge David Faulkner from Judge Saffold’s Defamation lawsuit?

After being apprised that the Ohio Supreme Court ordered the assignment of retired visiting judge David Faulkner to preside over the sham (Is there another kind?) defamation lawsuit filed against the Cleveland Plain Dealer by Judge Shirley Saffold and her daughter Sydney, I determined that it would be prudent for this Ol’ Dawg to engage in a little “due diligence” regarding this appointment.

My records prove that in the recent past that Judge Shirley Saffold was assigned to hear a case in Cleveland wherein retired judge Richard Markus claimed he was the victim of “intimidation” by ex-Ohio attorney Elsebeth Baumgartner of Sandusky, Ohio.

It should be noted that I first met Ms. Elsebeth Baumgartner in early 2001 after I filed 59 felony theft-in-office criminal complaints in Columbus v. nine (9) visiting retired judges for billing for hours they never worked and/or for travel expenses they could not have possibly incurred.

At this initial meeting with Elsebeth at my then home in Columbus, she advised me of evidence she had uncovered about corruption (subornation of perjury, fraud on the court) involving Erie County Prosecutor Kevin Baxter.

Before I go on further, it should be noted that this Ol’ Dawg is not an active apologist/enabler for Ms. Baumgartner in regards to her conduct over the past several years. Admittedly, in my opinion, Elsebeth was too trusting at the outset of her investigation into political corruption of alleged facts put forth by some self-serving litigants. However, in fairness to Ms. Baumgartner, at the time she was a licensed Ohio attorney who was under a sworn duty to report any and all corrupt activities to the proper Ohio authorities (Ohio Supreme Court/Count Prosecutors/State Attorney General.)

Retired Visiting Judge Richard of Cleveland, Ohio

In the mid-2000s, the Ohio Supreme Court assigned Judge Markus to a case and/or cases involving Ms. Baumgartner. It was obvious to me that the late Chief Justice Thomas Moyer appointed Judge Markus because he was a trusted member of his designated “hit team” that Moyer could rely on to render decisions punishing his real/perceived enemies and/or to reward his political friends/contributors.

I know what you’re thinking folks! How in the world can this Ol’ Dawg have the audacity to suggest that the late Chief Justice Moyer was personally involved in corrupting Ohio’s judicial system? Some would suggest that it is improper to attack the dead. If that were true, which it clearly is not, then

I learned early on and subsequently from investigative reporters such as the following named investigative reporters, that “due diligence” was a “must!”
  • Jon Craig – Columbus Dispatch-Cincinnati Enquirer
  • Jim Drew – Toledo Blade-Baltimore Sun
  • Jim Provance – Toledo Blade,
  • Darrell Rowland – Cincinnati Enquirer – Columbus Dispatch,
  • Rick Schmidt Wall Street Journal-LA Times
  • Dennis Willard/Doug Oplinger – Akron Beacon Journal
  • Emily Ramshaw – Dallas Morning News
  • Benjamin Morrison – Editor – Columbus Dispatch
  • Gary Scharrer – San Antonio Express News
  • Alan Abrams – Detroit Free Press – La Prensa – Toledo City Paper
One could only imagine the repeated successes (Pulitzer Prizes) if all of the above investigative reporters were employed by the same general circulation newspaper. Let me tell ya what boys and girls, it couldn’t get any better in alerting/informing us of t he corruption involving our public officials. Talk about a cadre of professionals dedicated to reporting the “truth” as your instructor, could it get any better? This Ol’ Dawg doesn’t think so!

Conclusion

Over the past twenty or more years, this Ol’ Dawg has spent an inordinate amount of time investigating the Ohio Judicial Industry. That ongoing investigation has led to the inescapable conclusion based on public records I’ve obtained that, the Ohio Judicial system has been corrupted to serve the interests of well-funded special interests to the overall detriment of Ohioans.

In all honesty, all any of us are entitled to is to have our case presided over by an unbiased jurist, right?

If the Judicial Industry whether it be in Ohio, California, Oklahoma or New York persists in dispensing favors (aka, rulings) to those who can afford to pay for them (aka, contributors), then we, and I mean we are in trouble!

In the instance of Ms. Elsebeth Baumgartner, I can personally assure you  that she was the victim of a personal vendetta put into motion by Chief Justice Thomas Moyer and facilitated by dishonest retired judges in his employ such as (a) Richard Markus, (b) Joseph Cirigliano and/or (c) David Faulkner.

And lastly, if the Plain Dealer’s attorneys lack the courage and/or fortitude to demand that retired visiting judge David Faulkner be removed from presiding over Judge Shirley Saffold’s sham defamation lawsuit, then the Plain Dealer deserves to lose!

Put simply, for the Plain Dealer to allow its fate to be determined by Judge Faulkner would be anologous to vounteering to have the late Jeffrey Dahmer act as an accredited food critic in regards to the dinners offered up by the late Idi Amin, ex-President of Uganda.
