Judge Warren McGraw of Pineville, WV; incompetent boob

The Lawyer Disciplinary Board found Dave guilty of the following misconduct.

In one matter involved Wyoming County vs.  U.S. Bank National Association, et al. Judge McGraw issued a ruling which dealt with the issue of whether the assignment of a trust deed, securing the payment of a promissory note for the purchase of residential real estate, must be recorded in the office of the clerk of the county commission.

The Bank Association moved the court to dismiss the complaint because West Virginia law did not require that trust deed assignments need not be recorded county record books. Shortly thereafter, Judge McGraw denied the motion to dismiss.

The Association then sought a writ of prohibition against Judge McGraw with the West Virginia Supreme Court to prohibit the enforcement of the denial to dismiss the complaint.

The Supreme Court granted the writ against judge McGraw and ruled that “West Virginia law does not require that the assignment of a trust deed, securing the payment of a promissory note for the purchase of residential real estate, must be recorded in the office of the clerk of the county commission.”

The Court went on to say that Judge McGraw “exceeded his jurisdiction allowing the Wyoming County action to go forward.”

Of course Judge McGraw doesn’t much give a damn how many times the Supreme Court reverses his asinine rulings since he cannot be removed from the bench for being a Moron.

As we speak (ca. June 2015), McGraw continues to sit as a Wyoming County Circuit Court judge in Pineville, West Virginia.
