Judge David Sims of Wheeling, WV; incompetent boob

In one matter, Judge Sims was assigned to handle a criminal matter involving a 12-year-old student who carried a weapon on school grounds with the intent to intimidate another student.

Subsequently, Judge Sims dismissed the criminal charges against the youngster by ruling that the boy was not competent to stand trial and that the charged criminal offense did not “involve an act of violence against a person.”

As a consequence of Judge Sims’ asinine ruling, Ohio County Prosecutor Scott R. Smith sought a writ of prohibition from the West Virginia Supreme Court prohibiting Sims from dismissing the criminal charges against the juvenile.

The Supreme Court subsequently granted the prosecutor’s request for a writ of prohibition by ruling that Judge Sims had exceeded his legitimate powers in dismissing the criminal complaint.

Of course Judge Sims doesn’t much give a damn how many times the Supreme Court reverses his asinine rulings since he cannot be removed from the bench for being a Moron.

As we speak (ca. June 2015), Sims continues to sit as a judge on the First Judicial Circuit Court in Wheeling, West Virginia.
