Former Judge Elaine Rushing of Santa Rosa, CA; lying loser

The state of California presented Elaine Rushing with a law license in 1969 after she graduated from the University of California Hastings Law School.

After being receiving a complimentary censure for drunk driving, Elaine decided to reap big bucks by become a private mediator with JAMS, a dispute resolution group. Apparently, no self-respecting law firm in the Bay area was about to offer he a good paying job.

In December 2014, Elaine was sued by a developer who accused her of fraud and misrepresentation while she oversaw a civil case in Santa Clara County for JAMS.

The suit was filed in Sonoma County Superior Court by counsel for a Saratoga developer, who claimed that Elaine did not disclose to the parties that was disciplined by the Commission on Judicial Performance in 2006. The judicial commission specifically found that Elaine lied to State Police offices and invoked her judicial office after crashing her Porsche following a night of boozing it up.

According to attorney William McGrane, as a consequence of Elaine’s concealment of her discipline, the developer was forced to disqualify Elaine mid-trial, wasting time and money. The attorney is asking for $1 million in attorney fees and an unspecified amount in punitive damages. JAMS is also named as a co-defendant. Mr. McGrane said in part:

• “My client, the Marazzo family trust, feels injured by Judge Rushing’s behavior in failing to tell the truth on her resume.”

It should be noted that as of April 14, 2015, Judge Rushing’s so-called bio on the JAMS website continues to conceal the fact that she was found to be a liar who attempted to abuse her judicial position when caught driving under the influence. Of course it cannot be disputed that JAMS and more importantly John Jay Welsh, executive vice president and general counsel along with its group president and CEO Chris Poole. The mere fact that they haven’t required Rushing to change her posted resume to include the findings that she’s a liar and a drunk is clearly an indictment on the way they conduct business.

All that’s left now is to see if attorney McGrane and his client, the Marazzo family trust succeeds in being awarded $1 million in fees and punitive damages against Rushing.

As we speak (ca. April 2015), Rushing continues to act as a overpaid mediator for JAMS at 50 Old Courthouse Square in Santa Rosa, California.
