Judge Marc Garcia of Merced, CA; greedy perjurer

 

The state of California provided Marc A. Garcia with a law license in 1983 after he graduated from th e San Francisco School of Law.

 

In 2007, former Gov. Arnold Schwarzenegger was duped into appointing Marc Garcia as a Merced County Superior Court judge. Marc didn’t receive the appointment because he was the most qualified attorney in the greater Merced area. He received it because had proven to be a reliable lackey for the local political hacks.

 

The California Commission on Judicial Performance has charged Judge Garcia with the following misconduct.

 

Prior to ascending the bench, Marc was hired as an associate by the Merced law firm of Cindy Morse and Thomas Pfeiff, known as Morse & Pfeiff. In 2001, Marc was made a partner and the firm changed to Morse, Pfeiff & Garcia.

 

Beginning in 2003 and continuing through at least 2013, Garcia’s firm had a contract with Merced County to provide indigent criminal defense serves at an annual fee of about $1.2 million.

 

After ascending to the bench, Garcia entered into a Dissolution Agreement with the Pfeiff firm. However, an addendum to the agreement called for Garcia to receive $250,000 at $4,518 a month beginning in January 2008 as his share of the proceeds of the ongoing indigent defense contract with Merced County.

 

Over the course of several years after he began to receive the $4,518 monthly stipend, Garcia continued to sit on criminal cases wherein his prior partners were employed as indigent defense counsel that specifically related to the income he was earning. However, Garcia never disclosed the ongoing payments to any of his presiding judges during that time span.

 

When the County extended the indigent defense contract with Garcia’s former firm, it was unaware that he had a financial interest in the contract.

 

On Garcia’s Statements of Economic Interest for years 2008 through 2012, which he executed under penalty of perjury, he failed to disclose the $250,000 income he received pursuant to the Terms of the Dissolution agreement.

 

All that’s left now is to see what if any punishment is meted to Garcia the Perjurer. If he’s lucky, he’ll receive a complimentary reprimand and a large bar of Dove soap.

 

And lastly, because Judicial Misfits in California are held to a much lower standard of conduct then every one else. Garcia has not yet been charged with perjury.
